0. Who We Are

The Service is owned and operated by Individual Entrepreneur Spievakova Maryna Hennadiivna, EDRPOU 3177907526, registration number 22240000000086519, address: Pavla Niryberga Street 10/134, Dnipro, Ukraine, email: hey@linkks.cc

(hereinafter - “Company”, “we”, “us”, “our”).

1. Definitions

• User - a person who creates an account or otherwise uses the Service.
• Page - a public or private page created by a User within linkks.
• Content - any materials added, displayed, or distributed via linkks, including text, links, images, videos, music, maps, files, buttons, forms, and contact details.
• Visitor - any person who views a User’s Page.

2. Acceptance of Terms and Governing Law

2.1. By accessing or using linkks, you confirm that you have read, understood, and agree to these Terms and all related policies, including the Privacy Policy.

2.2. These Terms are governed by the laws of Ukraine. Where applicable, the following laws may apply, without limitation:

• Law of Ukraine “On Electronic Commerce”
• Law of Ukraine “On Personal Data Protection”
• Law of Ukraine “On Copyright and Related Rights”
• Law of Ukraine “On Consumer Protection”

3. Changes to the Terms

3.1. We may update these Terms, related policies, or modify, suspend, or discontinue any part of the Service.

3.2. If changes materially affect your rights or obligations, we will make reasonable efforts to notify you in advance.

3.3. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

4. Account, Age, and Security

4.1. You must be at least 18 years old or have legal capacity to enter into these Terms.

4.2. You agree to provide accurate and current information and to keep it up to date.

4.3. You are solely responsible for maintaining the confidentiality and security of your account credentials.

4.4. You must not sell, transfer, lease, or otherwise assign your account or access to it without our prior written consent.

5. Username Policy and Squatting

5.1. Your chosen username must:

• not infringe intellectual property, trademark, or name rights;
• not mislead others or impersonate brands, organizations, or individuals;
• not be offensive, unlawful, or abusive;
• not be reserved for resale or speculative purposes (“username squatting”).

5.2. In the event of a dispute, we may request proof of rights, require a username change, temporarily restrict access, or reassign the username.

5.3. Usernames associated with accounts inactive for six (6) months may be reclaimed.

6. Acceptable Use and Prohibited Conduct

You agree not to:

• 6.1. Violate applicable laws of Ukraine or rights of third parties.
• 6.2. Upload malware, phishing content, scams, deceptive schemes, hidden redirects, or malicious code.
• 6.3. Use the Platform for harassment, threats, discrimination, hate speech, or unlawful propaganda.
• 6.4. Access the Service via automated means, including bots, scrapers, parsers, click-farms, or traffic manipulation tools.
• 6.5. Scrape, harvest, or mass-collect data from linkks Pages without lawful basis.
• 6.6. Attempt to bypass security measures, test vulnerabilities, reverse engineer, or gain unauthorized access.

7. Your Content and Responsibility

7.1. You are solely responsible for all Content you publish or distribute via linkks.

7.2. You warrant that you hold all necessary rights and permissions for your Content.

7.3. Public Pages may be accessed, shared, or referenced by third parties beyond the Platform.

7.4. Do not publish sensitive personal data (passport details, banking information, access codes, residential addresses) unless you have a lawful basis and necessity.

8. Moderation and Enforcement

8.1. We may, but are not obligated to, monitor or moderate Content.

8.2. If Content or conduct violates these Terms or applicable law, we may:

• remove or restrict access to Content;
• limit account functionality;
• suspend or terminate accounts;
• preserve logs or data for investigation or lawful disclosure.

8.3. Enforcement actions may be taken without prior notice where necessary to prevent harm or comply with legal obligations.

9. Intellectual Property Complaints (IP Notice)

9.1. To report alleged IP infringement, email hey@linkks.cc with subject “IP Notice”, including:

• your contact details and authority;
• URL(s) of the allegedly infringing Content;
• description and evidence of your rights;
• a good-faith statement regarding accuracy.

9.2. We may request additional information, temporarily restrict access, or remove Content.

9.3. Users may submit a counter-notice with evidence of rights, after which we will decide in accordance with applicable law.

10. Responsibility Toward Visitors and Data Processing

10.1. If you collect personal data from Visitors (via forms, links, or messages), you are the data controller and are solely responsible for lawful processing.

10.2. You must have a valid legal basis (consent, contract, legitimate interest, etc.) and comply with Ukrainian data protection law.

11. Platform Rights and License Limitations

11.1. All rights to the Platform, software, design, trademarks, and materials (excluding User Content) belong to the Company or licensors.

11.2. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

11.3. Copying, modifying, decompiling, reverse engineering, or attempting to derive source code is prohibited unless permitted by law.

12. License to User Content (Service Operation)

12.1. By publishing Content, you grant us a non-exclusive, royalty-free, worldwide license to:

• store, host, process, format, cache, and generate previews;
• publicly display Content within the Service;
• use limited excerpts to demonstrate Platform functionality.

12.2. This license is limited to what is necessary to operate and promote the Service. You retain ownership of your Content.

13. Data, Analytics, and Logs

13.1. We may collect technical logs and aggregated usage data to ensure security, stability, and analytics, in accordance with the Privacy Policy and Ukrainian law.

13.2. Aggregated and anonymized analytics generated by the Platform form part of the Service functionality.

14. Paid Plans (If Applicable)

14.1. linkks may offer free and paid plans. Pricing, features, and billing terms are displayed prior to purchase.

14.2. Cancelling a subscription stops future charges; access remains until the end of the paid period unless stated otherwise.

14.3. Refunds, where applicable, are handled in accordance with Ukrainian law and the nature of digital services.

This section does not introduce KYC, payment-provider seller-of-record status, or third-party monetization programs.

15. Third-Party Services

15.1. linkks may embed or link to third-party services (e.g., YouTube, Spotify, SoundCloud, Google Maps).

15.2. Such services operate under their own terms, and we are not responsible for their availability, content, or changes.

16. Disclaimer of Warranties

16.1. The Service is provided “AS IS” and “AS AVAILABLE”.

16.2. We do not guarantee uninterrupted operation, error-free performance, or compatibility with all devices or browsers.

16.3. You are responsible for maintaining backups of your Content.

17. Limitation of Liability

17.1. To the maximum extent permitted by Ukrainian law, we are not liable for indirect, incidental, or consequential damages, loss of profits, data, or reputation.

17.2. Our total liability is limited to the amount paid by you for paid linkks services during the preceding 12 months, unless mandatory law provides otherwise.

17.3. Nothing in these Terms limits non-waivable consumer rights.

18. Suspension or Termination

18.1. We may suspend or terminate accounts that violate these Terms, applicable law, or pose security risks.

18.2. Upon termination, Content may be permanently lost, except where retention is required by law.

18.3. Accounts may be deactivated due to prolonged inactivity or abuse prevention.

19. Feedback

If you submit feedback or suggestions, you grant us the right to use them without compensation or obligation.

20. Dispute Resolution

20.1. Before initiating legal action, you agree to contact us at hey@linkks.cc to attempt resolution.

20.2. Disputes shall be resolved in accordance with the laws of Ukraine in competent courts.

21. Final Provisions

21.1. If any provision is deemed invalid, remaining provisions remain in force.

21.2. You may not assign rights or obligations under these Terms without our written consent.
